By means of Decree No. 338/2025, published in the Official Gazette on May 20, 2025, Section 75 of the Civil and Commercial Code was amended to provide that the parties to a contract may establish an electronic domicile in which to validly serve notices, communications and summons arising from the contract.

It is worth noting that, although the possibility now expressly provided for in the legal provision is not new since that the principle of party autonomy governs contractual matters, a similar provision had already been incorporated in 2020 by Law 27,551, which amended several rules related to the lease contract and was later repealed by Decree No. 70/2023 in December 2023.

Although this provision was established within the framework of the enactment of a series of amendments to the Aeronautical Code, it is applicable to any kind of contract since the aforementioned Section is included in the General Part of the Civil and Commercial Code.
