Elimination of Mandatory Contributions to Business Chambers
As of June 3, 2025, Decree 149/2025 comes into effect. This decree establishes that Collective Bargaining Agreements may no longer include clauses that impose contributions, fees, or economic charges on employers who are not affiliated with the business chambers or associations that signed the agreement, unless such employers voluntarily accept these charges. Furthermore, new collective bargaining agreements that contain such clauses will not be registered or approved.
Examples of contributions affected by this measure include those destined for entities such as INACAP (commerce sector) or IERIC (construction sector), where mandatory contributions applied to all employers until now. With the enforcement of Decree 149/2025, contributions to these and similar entities will only be valid if the employers have agreed to be part of them. If they have done so, they may revoke their acceptance at any time.
